This book provides guidelines for professionals in human resources, diversity and law who are faced with issues of transgender inclusion in the workplace, including transgender basics, gender identity law, policy issues regarding gender transition planning, bathrooms and dressing rooms, dress codes, identification and records changes and health benefits, as well as sample gender transition guidelines. This is one of the only books currently available on the subject.

This article proposes that the right to privacy in U.S. constitutional law creates a right to determine one’s gender identity despite governmental regulations to the contrary.

 

Weiss, T.J.  (1994)  The Exception to the Exclusion In Liability Insurance Contracts Through A Procedural Lens. Washburn Law Journal 33, 364-382; reprinted in National Insurance Law Review 7:399-420.

This article examines how to interpret insurance contracts that contain potentially confusing exceptions to exclusions.

 

Weiss, T.J. (1993) A Natural Law Approach to Remedies for the Liability Insurer's Breach of the Duty to Defend: Is Estoppel of Coverage Defenses Just? Albany Law Review 57, 145-167 (1993)

This article analyzes a little-known rule that requires insurance companies to pay liability claims despite lack of coverage if they have incorrectly refused to pay for a defense of their policyholder.

This article reviews a book by Professor Christopher Wolfe of Marquette University regarding the political and legal history of the constitutional doctrine of judicial review.

 

Weiss, T.J. (1985) The Child Pornography Act of 1984: Child Pornography and the First Amendment. Seton Hall Legislative Journal 9, 327-353. 

This article reviews a law against child pornography, and suggests that the First Amendment freedom of speech provides no defense to child pornographers.

 

2. Work in Progress

Article,“Sex and the Supreme Court:  Transgender Protections in Title VII”

This article of approximately 50 pages reviews the Civil Rights Act of 1964 and discusses whether the U.S. Supreme Court will side with lower courts that have held discrimination against transgender employees to be “sex discrimination” under that Act.

4. Doctoral Dissertation

"The Cutting Edge of Employment Diversity: Transgender Human Resources Policies in U.S. Employers."  Diss. Northeastern U. 2004

In my dissertation, I conducted intensive interviews with 43 officials and employees who were involved with the adoption of transgender policies at 33 organizations.  These interviews suggest that leading-edge companies are responding to an increase in minority demographics, a shrinking labor market and a perception of increased competition for talent.
